The European Council of Justice continued today the discussions of the four questions of the case. The new evidence that came unexpectedly to the surface, that is to say, that Diego Fernandes is not an European citizen and he had committed a fraud , made it essential for both sides to adjust their arguments to them. More analytically, the defense side stated that Morocco prisons fail to meet the international standards, which is confirmed by three Humanity Organisations. The conditions of the prison in Morocco are doubtless far worse than in Latvia. That is the reason why it would be more beneficial to be judged by Spanish authorities. Such a cruel punishment would violate his human rights according to the EU Charter of Fundamental Rights. The opposite side stated that since it is proven that Mr. Fernandes is deprived of the Spanish nationality, tge matter falls out the EU scope. Latvia only used its competence on applying the extradition rules on non- nationals and this is not discriminatory at all, since art. 28 paragraph 2 TFEU states that discrimination lies between EU- citizen and there is no such case here.
