Day 2 – ECJ

The session started with an ice breaking introduction activity of all the judges of the chamber and they changed wishes for a fruitful debate. All the applicants and defenders were present. Afterwards both parties expressed their opinions and present their points of view for the case of the trial of Demond, who was arrested back in 1993 but he has never summoned in the trial. However, he had sent loyers in order to defend him and paid the bill although he didnt fullfill the conditions, left France and went to the Hungary.
The issue is that before 2002 there was not a European law in order to clarify the procedure and Mr. Demont gave to the Hungarian authorities false information about his address so no one could find him.
Hungary claimed that the case was not problem of the country so followed the national procedures prior to the EU legislation since it was absent .
Both parties support their opinions and the judges asked their question.
